Are there workplace injuries that are not eligible for coverage?

If you have been injured on the job, you are likely very concerned with how that injury will affect your health. You may also be nervous about what the injury will mean for your finances. There will typically be medical bills, lost wages and other financial hardships suffered as a result of serious injuries, so it can be crucial to understand your options for compensation.

In many cases, an injured worker will be eligible to receive workers' compensation, which is employer-paid insurance that allows you to collect money to cover some of the expenses incurred as a result of your injury. However, there are some cases when a workplace injury may not be covered by workers' compensation insurance.

According to Ohio workers' compensation laws, a person will generally be ineligible to collect workers' compensation benefits if:

  • The injury was self-inflicted
  • The worker was intoxicated at the time of an accident
  • The worker was under the influence of drugs, unless prescribed by a physician
  • The worker is an inmate at a correctional facility
  • The injury was suffered in a fight instigated by the worker seeking benefits

In these cases, an application for benefits will typically be denied, even if an accident occurred on a job site and through the course of a person's employment.

If none of these factors contributed to an injury or illness, a worker should be able to pursue benefits successfully. However, any person applying for workers' compensation can run into some complications and obstacles during the process of seeking payment which can negatively affect a claim, so it can be a good idea to speak with an attorney to discuss your individual case.
