Who and what is covered by workers' compensation benefits

Workers' compensation covers most workers and variety of workplace accidents with a few exceptions. Injured workers and their families should know when a worker is covered, the types of workers' compensation benefits that may be available to them and how they can obtain the benefits they need when they need them.

Workers' compensation benefits are referred to as no-fault which means they are designed to protect workers injured on-the-job even if they were being careless when they were injured. Injuries that may not be covered by workers' compensation benefits can include those that were suffered in the workplace when the injured worker was under the influence of alcohol or drugs; that took place while the worker was not at their workplace; when the worker was violating the law at the time they suffered the injury; or if the injuries were self-inflicted.

Workers that are not covered by workers' compensation benefits include independent contracts; business owners; volunteers; famers and farmhands; workers in private homes; maritime workers; railroad workers; and some other categories of workers. Most workers are covered and protected by workers' compensation benefits.

Injured workers may be able to recover workers' compensation payments for medical care that is needed as a result of their occupational injury or illness; replacement income for lost wages while they are unable work while away recovering; occupational rehabilitation costs; compensation for permanent injuries and disability; and benefits for surviving family members when a worker has been killed in a fatal workplace accident. These benefits are vital for injured workers and their families struggling through the difficulties associated with a workplace accident which is why injured workers and their families should be familiar with workers' compensation protections available to them.
